Trademark Policy

Welcome to the 8PAY (“We”) Trademark and Trademark Policy ("Policy"). This Policy describes the conditions under which it is possible to use our brands and trademarks.

Why is this Policy necessary? While we encourage active and decentralized innovation on the 8PAY platform, we want to ensure that our community has a consistent, high-quality experience with the 8PAY brand. Our ultimate Trademark Policy helps everyone in the ecosystem avoid and stop scammers who may be using the 8PAY name to steal, defraud or mislead.

Basically, brands are meant to eliminate confusion; a protection that is in everyone's interest. For example, if someone forked the Bitcoin network and named it 8PAY 2.0, many members of our community would be confused to say the least. In this case we would strongly apply the 8PAY brand.

On the other hand, suppose someone released a high-quality wallet app for 8PAY cryptocurrencies and tokens and wanted the tagline to be "Powered by 8PAY ™". Of course, we want to encourage this kind of innovation. In this case, provided the software team has contacted us in advance, it is likely that we will allow the use of our brand.

If you wish to use any of the 8PAY Trademarks (explained below) in a manner not expressly permitted by this Policy, please contact us directly at [email protected]. We all share the same ultimate goal: to make the 8PAY network a thriving global payment platform and we want this branding policy to promote our shared work, not stop it.

Brand intent and brand policy

We appreciate the trust our community has placed in our team and technology. We protect our trademark rights to ensure that the 8PAY name stands for quality and integrity, both today and in the future.

Please note that our branding policy does not categorically prohibit our community from using 8PAY Brands. In fact, we encourage members of our community to use 8PAY brands, as long as they do so in an acceptable and consistent way.

In general, you can use the 8PAY Trademarks in the manner permitted in this Policy provided that you do not do one of the following:

A. Some Personal Non-Commercial Uses
You can use the 8PAY trademarks to express your affinity for our products in a truthful, personal and non-commercial way, such as on t-shirts, stickers and other things you share with your friends.
Whenever you use an 8PAY brand in this way, don't hesitate to send us a sample - we'd love to see what you're doing! However, if you wish to make commercial use of these types of items (for example, sell stickers or clothing bearing our 8PAY brands), you must first obtain our written permission.

B. Trade Names, Trademarks, Domain Names, and Internet Account Names
You may not use the 8PAY trademarks in or as part of any trade name, trademark, domain name, Internet account name or social media name without the prior written consent of 8PAY Development Foundation.
For example, the trade name or trademark "8PAY Tech Support" or the Twitter handle "@ 8PAYTechSupport" are not allowed, because consumers who see such uses are likely to assume they are official 8PAY services or accounts.
Likewise, the domain name "8PAYTechSupport.com" or the Facebook group "8PAY Tech Support" is also likely to be confusing. If you would like to use the 8PAY Trademarks in or as part of any Internet trade name, trademark, domain name or account name, please contact us to discuss the planned use.

C. Derivative Software
All 8PAY software offerings are provided on a free and open source basis. All 8PAY source code is governed by the GNU GPLv3 license; you can read, use, review the code, except distribution of closed source versions.
However, please note that software brands and trademarks are designed to designate the software vendor. In this respect, the software you have modified and that you provide is different from the software provided by 8PAY. Therefore, it is not possible to mark derivative software in a way that could cause confusion as to its origin or origin. For example, if you fork our 8PAY software, you may not distribute the modified software under the 8PAY brand or under any 8PAY brand.

D. Services related to 8PAY software and services
